INTRODUCTION

This website is owned and operated by the Institute of Health Visiting, a registered Charity (number 1149745) whose registered office is located c/o Royal Society of Public Health, John Snow House, 59 Mansell Street, London E1 8AN, (also referred to as “we”, “us”, “our” or “Institute”).

By using our Website, you are agreeing to be bound by the following Terms and Conditions.   Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms.  Should you disagree with any part of these Terms, then you may not access the Website.  Agreement to these Terms shall also be deemed as agreement to our Accessibility and Privacy and Cookies Policies.

  1. DEFINITIONS

“Associate” – means a Membership available to a qualified and practising health visitor;

“Braintree” – means our payment partner agency in respect of Membership Levels identified in Condition 3.7.3;

“Corporate” – means a Membership to the Institute that is paid for by an employing organisation;

“Friend” – means a person who is not a qualified health visitor but wishes to join the Institute as they have an interest in the wellbeing of children or wish to support the Institute as a charity;

“GoCardless” – means our payment partner agency in respect of Membership Levels identified in Condition 3.7.2;

“International Associate” – means the Membership available to a qualified and practising health visitor who resides outside of the United Kingdom;

“International Friend” – means the Membership to a person who is not a qualified health visitor but wishes to join the Institute as they have an interest in the wellbeing of children or wish to support the Institute as a charity;

“International Group” – means a Membership to the Institute that is paid for by an employing organisation based outside of the United Kingdom;

“International Membership” – means the Membership available to a User who lives outside of the United Kingdom;

“International Student” – means the Membership available to a qualified nurse currently enrolled for a health visitor qualification at a higher education establishment who resides outside of the United Kingdom;

“Member” – means any person registering for Membership of the Institute via the Website and subsequently accessing the Website as a Member (also referred to as “you”, and “your”);

“Membership” – means the provision of a Membership to the Institute and an online account accessible via the Website;

“Membership Donation” – means the donation payable by the User to become a Member;

“Membership Level” – means Associate, Friend, Retired, Student, Corporate, International Associate, International Student, International Friend and International Group;

“Retired” – means a qualified health visitor who has retired from practice;

“Student” – means a qualified nurse currently enrolled for a health visitor qualification at a higher education establishment;

“Terms” – means the terms and conditions set out in this document;

“User” – means any person accessing and/or using the Website at any time (also referred to as “you”, and “your”);

“Website” – means www.ihv.org.uk.

  1. COPYRIGHT AND CONTENT

2.1 This Website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is strictly prohibited unless otherwise agreed in writing by the Institute.

2.2 Content on this Website is licensed under an Attribution-NonCommercial-ShareAlike 3.0 License unless otherwise stated. Where a photograph or image is placed, credited http://creativecommons.org/licenses/by-nc-sa/3.0/.

We take reasonable care to ensure that the information appearing on this Website is accurate and up-to-date. However, errors and omissions do occur, and you should not take the accuracy of the information for granted, but should check directly with us using the contact details provided on the Website. We therefore disclaim all liability for your use of the information on this Website.

2.4 Members are able to post, link, store, share and otherwise make available certain information, text, graphics, videos or other material via our online forums. All Members are responsible for ensuring the legality of their own content and appropriateness of language used.  All Members should avoid discussion of clinical work where any information can lead to the identification of individual patients or clients.

  1. MEMBERSHIP

3.1 Any User may apply for Membership via the Website. The Institute has a number of Membership Levels that may be appropriate for the User, and the User is responsible for determining which Membership Level applies to them.

3.2 The Membership Levels currently available are Associate, Student, Friend, Retired, Corporate, International Associate, International Student, International Friend and International Group.

3.3 The Member agrees that all details provided at registration are correct to the best of their knowledge including acknowledgement of their eligibility of Membership Level.

3.4 Following registration on the Website, the User acknowledges that they will not become a Member until their initial payment has been received by the Institute.

3.5 Upon receipt of the initial payment, we shall send a welcome email to the Member advising how to validate their Membership. The User accepts that the initial payment can take up to ten (10) days to reach the Institute.

3.6 Following receipt of the welcome email, the Member can log in to the members-only area of the Website and may use the Website in accordance with these Terms.

3.7 Donations

3.7.1 Membership Donations

Membership Donations differ dependent on Membership Level.  Please click here for the latest prices.

3.7.2 Associate, Friend, Retired and Student Membership

(a) Payment of the above Membership Levels shall be made by monthly direct debit via our payment partner GoCardless. Upon registration, you will complete a direct debit form which will set up a mandate for payments to be taken directly from your bank account each month. These payments will continue until you cancel your Membership in accordance with Condition 3.8.

(b) Associate, Friend and Retired Membership Levels are also payable annually by cheque.

(c) The Institute does not accept any responsibility in terms of confidential data with respect to payment information for any Membership Level under this Condition 3.7.2. This is solely the responsibility of our partner, GoCardless.  For further information regarding how GoCardless works, please visit their customer support webpage here.

3.7.3 International Associate, International Student and International Friend Membership

(a) Payment of these Membership Levels shall be made annually by credit or debit card only via our payment partner, Braintree. All such payments will be subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to us, then we will not be able to confirm your Membership.  We will write to you at the email address provided as soon as possible to advise that your Membership application has not been successful.  Renewal of these Membership Levels is not automatic and we will contact you by email one month prior to expiry to identify whether further Membership is required and to advise of any further payment required.

(b) The Institute does not accept any responsibility in terms of confidential data with respect to payment information for any Membership Level under this Condition 3.7.3. This is solely the responsibility of our partner, Braintree.

3.7.4 Corporate and International Group Membership

Users are not able to register online for Membership under these categories and all enquiries regarding price and payment should be made in writing to [email protected].

3.8 Cancellation of Membership

3.8.1  Should the Member wish to cancel at any time, notification is required in writing to the Institute in the form of an email to [email protected].  As soon as this is received by the Institute, and we have acknowledged receipt by email, your Membership will be cancelled and no further payments shall be taken.

3.8.2 In the unlikely event that the Institute takes a further payment following cancellation, the Institute will issue a refund in accordance with Condition 3.9 below.

 3.9 Non-Payment of Donation

3.9.1 Should your direct debit donation not be honoured by your bank for any reason, we will immediately suspend your access to the website.

3.9.2 We will write to you by email to advise and confirm that, unless we are notified otherwise, we will request your donation again in 7 days.

3.9.3 Should that donation be rejected, we will terminate your Membership and advise you accordingly by email.

3.9.4 You agree that, unless you have notified us otherwise, we have the right to request payment again under this Condition 3.9.

3.10 Refunds

3.10.1  As a charity, the Institute operates a strict no refund policy.  However, where the Institute is at fault and has taken an unauthorised payment or overpayment following cancellation in accordance with Condition 3.8, the Institute shall process a refund of that overpayment.

3.10.2  The Member accepts that any refund processed may take up to five (5) working days to be credited back to their account.

3.10.3  There may be instances where the terms of a refund may differ, i.e. training events or conferences, and the Institute shall ensure any variation shall be clearly identified on application to such events.

  1. COMPLAINTS

4.1 The Institute shall deal with any complaints, received from whatever source, in a prompt, courteous and efficient manner.

4.2 Complaints should be made in writing to [email protected] or by post to Institute of Health Visiting, c/o RSPH, 59 Mansell Street, London E1 8AN.

4.3 The Institute shall keep a written record of all complaints received and of the action taken in respect of such complaints.

4.4 We will respond to your complaint within five (5) working days. If we are unable to resolve your complaint satisfactorily, you have the right to make a complaint directly to the Charity Commission via their website https://www.gov.uk/complain-about-charity.

4.5 Governing Law

Any complaint concerning or arising from this Website is to be determined in accordance with the law of England and Wales, and the courts of England and Wales are to have exclusive jurisdiction in determining such complaints.

  1. EXCLUSION OF LIABILITY

5.1 This Website is provided on an ‘as is’ and ‘as available’ basis. We are not liable for any loss or damage arising directly or indirectly from use of this Website, except death or personal injury to the extent this is caused by our negligence. Examples of loss or damage for which we are not liable include (but are not limited to) any loss or damage resulting from:

  • your reliance on or use of any information or material obtained either directly or indirectly from the use of this Website.
  • the transmission, reception or use by any person of information by about or to you; any inaccuracies in any information on this Website; the unavailability of this Website.

5.2 Whilst every effort has been made to ensure that the information contained on this Website is accurate and updated, because of the nature of this medium, the Institute does not accept responsibility for the accuracy or validity of any of the information contained in or accessed from this Website and accepts no liability for errors, loss or damages suffered by use of or reliance on any information published here. Similarly, we do not endorse any product or information accessed through this Website, or intend to create any contractual or other legal relation with any person using this Website.

  1. VIRUSES, HACKING AND OTHER OFFENCES

6.1 By using our Website, you agree that you will not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which may be malicious or harmful. You must not attempt to gain unauthorised access to the Website, our servers or any server, computer or database that may be connected to our Website.

6.2 By breaching this Condition 6, you have committed a criminal offence under the Computer Misuse Act 1990. Any such breaches shall be reported to the relevant authorities.  In the event of such a breach, your right to use our Website will cease immediately. We will not be liable for any loss or damage caused by you as result of your actions whilst in breach of this Condition.

  1. CODE OF FUNDRAISING PRACTICE

7.1 The Institute shall ensure that all fundraising on behalf of the Institute shall be guided by the Fundraising Codes of Practice.

  1. MODIFICATION OF TERMS

8.1 We reserve the right, at our sole discretion, to modify or replace these Terms in part or in whole at any time.

8.2  The Terms displayed on the Website on the day a User or Member visits the Website shall be the Terms that apply for that visit.
